Why did we do this inspection?

What did we find?

The Department of Home Affairs ’( Home Affairs) operation of the Civil Maritime Surveillance Services contract has not been effective and, as a result, while surveillance services have been handed, the amount and range of those services has fallen short of the contractual conditions.

With 40 contract variations, the compass of contract services has changed, the cost has increased and the delivery timeframe has been extended.

There were faults and detainments in the provision of the contracted surveillance means.

Home Affairs has not entered the needed amount of surveillance services and the aircrew conditions haven’t been met.

What did we recommend?

The Adjudicator- General made four recommendations to Home Affairs for unborn civil maritime surveillance contracts aimed at developing a stronger frame for the coming contract, and bettered contract operation practices.

Summary and recommendations

Background

Civil maritime Surveillance services has been linked by the Department of Home Affairs( Home Affairs) as important to inhibiting, precluding, detecting and responding to civil maritime pitfalls, including illegal maritime advents as part of Operation Sovereign Borders. Following a tender process, on 3 March 2006 a contract commenced between the Australian Government1 and Surveillance Australia Pty Ltd( Surveillance Australia) for the provision of a ‘ descry- Classify- Identify- Report ’ surveillance service to inform ‘ maritime zone mindfulness ’.

The inspection ideal was to assess whether the Department of Home Affairs is effectively managing the Civil Maritime Surveillance Services contract.

To form a conclusion against the ideal, the following high position criteria were espoused

The department’s operation of the Civil Maritime Surveillance Services contract has not been effective and, as a result, while surveillance services have been handed, the amount and range of those services has fallen short of the contractual conditions.

The contract has not been managed to secure delivery in line with the planned cost, compass and delivery timeframe. The contract has been varied on 40 occasions as of March 2021 with the effect of significantly changing the compass of the services to be delivered and adding the term and value of the contract. The department has recognised that variations to the contract have significantly reshaped it and those variations have increased the cost by further than 29 per cent. There has been a high development of officers responsible for the operation of the contract and the department has not assured that each of its contract directors had applicable training or experience.

Surveillance means

Not all specified means have been handed as firstly contracted. While four bases have been established and maintained, there was an eight month detention in establishing the fourth base. While twelve aircraft have been handed, there were detainments to the revision program that meant four completely biddable aircraft weren’t available at the inception of services, and there was also a 23 month detention in the provision of the SIM needed for the acceptance of the full surveillance system. At the inception of services on 1 January 2008, the full contingent of aircrew wasn’t handed, with only 17 aircrews out of the needed aggregate of 26 available, a space of 35 per cent.

Home Affairs didn’t effectively manage faults of surveillance means through the contractual frame. Home Affairs approved contract variations and made fresh concessions which reduced Surveillance Australia’s exposure to penalties available under the original contractual frame Surveillance services.

Contracted surveillance services

Home Affairs has not been carrying the full amount of surveillance services it contracted to admit. The contracted periodic RoE in terms of hours flown has not been achieved in any time, falling short by seven per cent on average. In addition, while 64 per cent of the total operations planned have been completely completed as briefed, a significant proportion haven’t with 25 per cent of operations incompletely completed and 11 per cent cancelled or abandoned. Further, while the surveillance services have been accepted seven days a week as intended, night operations have reduced significantly over time, long range operations aren’t being conducted and it has been further than nine times since any reserve operations have been planned or conducted.7

The full complement of good aircrew needed under the contract has noway been handed. On average over the life of the contract to 31 December 2020, the number of good aircrew has been 33 per cent below that contracted. The lack of aircrew has been a crucial contributing factor to faults in the number of surveillance hours and operations flown. The ANAO estimates that Home Affairs may have paid$ 87 million in yearly service charges for crew figures that it didn’t admit.

Home Affairs has not effectively managed performance faults and has continued to pay the full quantum for services and aircrew it has not entered. As a result of its disinclination to use performance operation vittles in the contract to their full extent, Home Affairs has only applied$2.3 million in performance deductions. Applicable arrangements aren’t in place to give assurance over contractor performance in undertaking operations.
